ADMINISTRATIVE DECISIONS - PROCEDURE

Information on the manner of case reception and settlement

Scheme of the procedure describing the process of issuing the administrative decisions.

The description of the administrative decision issuing

 

  1. The proceeding shall be executed in accordance with the rules of the Code of Administrative Proceedings.
  2. The party's moving with application on initiating the administrative proceeding - submission of the application to the proper body of inspection - in accordance with competences as well as after paying the fee. The party shall submit two copies of documentation in case if the decision is issued by the Main Pharmaceutical Inspector, after taking an opinion on the Voivodeship Pharmaceutical Inspector. The second copy shall be sent to the proper Voivodeship Pharmaceutical Inspector.
  3. After submission of the documentation the next step is their initial analysis and evaluation. In case of finding that there is lack in documentation, the mover is called to complete the documentation in 7 days in accordance with article 64 of the Code of Administrative Proceedings.
  4. Starting the administrative proceeding shall follow the eventual completing of the documentation.
  5. During execution of proceeding, in accordance with the separate procedure, one can run an inspection, ask other body for opinion. In case of finding the lack, the party can be called for giving additional explanations or completing documentation.
  6. After finding that all transgressions are removed, the documentation shall be analyzed in detail and the project of the decision shall be prepared.
  7. Issuing the decision.
